HEADLINE: Jury Says Poker
is Predominantly a Game of Chance

After only two hours of deliberation, the jury in the court case
against Derek Kelly, owner of the popular Gutshot card room in
London, returned a verdict of “Guilty” for hosting
poker
games and taking a cut of the pot without the requisite gaming
license. The jury was apparently not persuaded by the defense’s
argument that poker
is predominantly a game
of skill rather than chance and thus should not fall under the
restrictions of “Games of Mixed Skill and Chance”
as defined by the Gaming Act of 1968.
The prosecution stated in its closing argument that poker was
indeed a game of both skill and chance under the Act “because
before a game
can start someone shuffles the cards.”
The defense countered, “If we accept that a game of chance
includes all games
of combined chance and skill, every game
you could possibly think of would fall foul of this particular
Act.” Apparently referencing games such as bridge and chess
that are very popular in the UK.
Whether Kelly will now appeal the verdict is unknown but he did
say afterwards, “Me and Barry Martin (the club’s chief
executive) will continue to campaign to have poker
played among normal people and not casinos.”
Perhaps someone should tell Mr. Kelly that there are plenty of
“normal people” already playing at the best
